Lawyers UAE features forums where Users may participate in the general discussion of law, discuss the qualifications of lawyers or other non-confidential topics. Communications may be unprotected against disclosure by the attorney-client privilege or other privilege doctrines.

Limited Scope Initial Consultations. Users may engage in limited-scope initial consultations on Lawyers UAE for a fee. Lawyers UAE may be used to send communications and payments for limited-scope initial consultations between a querying-User and an attorney-User. The fee may be pre-authorized, processed, transferred or refunded in a manner deemed appropriate by Lawyers UAE in its sole and absolute discretion. Payment does not give querying-Users a right to receive an initial consultation or other services from an attorney-User. Querying-Users acknowledge that an attorney-User has the right to revoke an offer for an initial consultation before or after payment is made for any reason, including but not limited to: the identification of a potential or actual conflict of interest, scheduling conflicts, or if the attorney-User believes that he or she does not have the relevant expertise to provide consultation to the querying-User. The Users agree that any consultation on Lawyers UAE is limited in scope to preliminary advice based upon the information posted by the querying-User on the Lawyers UAE website. The querying-User understands and acknowledges that any advice received is preliminary in nature and does not act as a substitute for an in-person consultation and full review of the matter by a qualified attorney. The querying-User further understands and acknowledges that at the time of an initial consultation on Lawyers UAE, the attorney-User does not have access to all of the information necessary to provide full legal advice to the querying-User and that any advice received by the querying-User is, therefore, preliminary in nature. The attorney-User shall have no obligation to provide legal services beyond the limited scope initial consultation. If a querying-User decides to retain additional services of an attorney-User on Lawyers UAE, the querying-User should request to enter a written legal services agreement detailing the terms and conditions of the representation, including all fees, expenses and other obligations. All parties acknowledge that Lawyers UAE is not a party to any representation that may occur beyond the limited scope initial consultation, and agree to hold Lawyers UAE harmless for any disputes arising out of such representation.

Proceeds from a paid initial consultation may be deposited into the bank account selected by the attorney-User. The benefits each attorney-User is entitled to may depend upon the membership plan selected by the attorney-User. Attorney-users may cancel their membership at any time and are not entitled to a refund on a pro-rata or other basis. Attorney-users acknowledge and agree that Lawyers UAE has the right to revise the benefits of each membership plan at any time, and that the attorney-User’s sole recourse to such revisions is to cancel their membership.

Attorney’s Duties Regarding Conflicts, Competence, and License. All attorney-Users must ensure that there are no conflicts of interest and that the attorney-User is capable of competently providing the initial consultation requested. The fee paid by the querying-User is not paid to the attorney-User until the initial consultation has been rendered. Thus, if any issue prevents the attorney from being able to provide the initial consultation, the attorney-User has the obligation to quickly conclude the initial consultation as soon as possible and allow for the querying-User to receive a refund and/or select another attorney-User. All attorney-Users warrant that they are licensed to practice law and in good standing with one or more state bar associations in the United Arab Emirates or Dubai at the time of creating a Lawyers UAE account and at the time of offering and providing consultation services to querying-Users. Attorney-Users agree that they will discontinue offering and providing services on the Lawyers UAE platform and remove their account from Lawyers UAE immediately if his or her license to practice law is suspended or revoked.

Attorney-Users agree that they will complete initial consultations and submit billable time within three (3) days after the client preauthorizes payment by selecting the Submit Time option on the Messages page including the chat history with the querying-User. Attorney-Users acknowledge that they forfeit any right to receive a payment if they have not completed the initial consultation and submitted time by the deadline. Attorney-Users acknowledge that the satisfaction of a querying-User is guaranteed, and any charges that are disputed for any reason will not be paid.

These terms of Use expressly exclude and disclaim the terms of the U.N. Convention on Contracts for the International Sale of Goods, which shall not apply to any transaction conducted through or otherwise involving this website.

Dispute Resolution; Arbitration. Amal Khamis Advocates & Legal Consultants or Lawyers UAE and you agree to attempt to resolve all disputes informally for 30 days prior to filing for arbitration. In the event, we are unable to resolve the dispute and at least 30 days have passed since all parties have been on notice of the existence of the dispute, Amal Khamis Advocates & Legal Consultants or Lawyers UAE and you agree to arbitrate all disputes and claims between us before a single arbitrator. The types of disputes and claims we agree to arbitrate are intended to be broadly interpreted. It applies, without limitation, to claims arising out of or relating to any aspect of the relationship between us, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory; claims that arose before these or any prior Terms (including, but not limited to, claims relating to advertising); claims that are currently the subject of purported class action litigation in which you are not a member of a certified class; and claims that may arise after the termination of these terms. For the purposes of this Arbitration Agreement, references to “Amal Khamis Advocates & Legal Consultants or Lawyers UAE” “we” and “us” include our respective subsidiaries, affiliates, agents, employees, predecessors in interest, successors, and assigns, as well as all authorized or unauthorized users or beneficiaries of services or products under these terms or any prior agreements between us. Notwithstanding the foregoing, either party may bring an individual action in small claims court. You agree that, by entering into these terms, you and Amal Khamis Advocates & Legal Consultants or Lawyers UAE are each waiving the right to a trial by jury or to participate in a class action. These Terms evidence a transaction or website use in interstate commerce, and thus the Federal Arbitration Act governs the interpretation and enforcement of this provision. This arbitration provision will survive termination of these terms. A party who intends to file an action in small claims court or seek arbitration must first send, by UAE certified mail, a written Notice of Dispute (“Notice”) to the other party, which shall be addressed to: case@lawyersuae.com (the “Notice Address”), and an electronic copy must be sent via email to raj@lawyersuae.com. The Notice must (a) describe the nature and basis of the claim or dispute and (b) set forth the specific relief sought (“Demand”). If Lawyers UAE and you do not reach an agreement to resolve the claim within 30 days after the Notice is received, you or Lawyers UAE may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by Lawyers UAE or you shall not be disclosed to the arbitrator until after the arbitrator determines the amount, if any, to which you or Lawyers UAE is entitled. The arbitration will be governed by the Commercial Dispute Resolution Procedures and the Supplementary Procedures for Consumer-Related Disputes of the UAE Arbitration, as modified by these terms, and will be administered by the AAA. The arbitrator is bound by these terms. The arbitrator shall issue a reasoned written decision sufficient to explain the essential findings of fact and conclusions of law on which the award is based. The parties agree that any awards or findings of fact or conclusions of law made in an arbitration of their dispute or claim are made only for the purposes of that arbitration, and may not be used by any other person or entity in any later arbitration of any dispute or claim involving Amal Khamis Advocates & Legal Consultants or Lawyers UAE. The parties agree that in any arbitration of a dispute or claim, neither party will rely for preclusive effect on any award or finding of fact or conclusion of law made in any other arbitration of any dispute or claim to which Amal Khamis Advocates & Legal Consultants or Lawyers UAE was a party. The arbitrator may award injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. YOU AND Amal Khamis AVOCATES & LEGAL CONSULTANTS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITIES AND NOT AS PLAINTIFFS OR CLASS MEMBERS IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING OR IN THE CAPACITY OF A PRIVATE ATTORNEY GENERAL. The arbitrator shall not have the power to commit errors of law or legal reasoning, and the parties agree that any injunctive award may be vacated or corrected on appeal by either party to a court of competent jurisdiction for any such error. Each party will bear its own costs and fees on any such appeal. The arbitrator shall not award relief in excess of what these terms provide or award punitive damages or any other damages not measured by actual damages. Further, unless both you and Amal Khamis Advocates & Legal Consultants or Lawyers UAE agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding. If this specific proviso is found to be unenforceable, then the entirety of this arbitration provision shall be null and void. All aspects of the arbitration proceeding, and any ruling, decision or award by the arbitrator, will be strictly confidential, other than as part of an appeal to a court of competent jurisdiction. The Arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability or formation of this Agreement including, but not limited to, any claim that all or any part of this Agreement is void or voidable. If this specific proviso is found to be unenforceable, it is severable from the rest of the arbitration agreement.
