What is a Red Notice and what must it satisfy?

A Red Notice is a request to law enforcement worldwide to locate and provisionally arrest a person pending extradition, surrender or similar legal action, based on a warrant or court order from the requesting country.

It must comply with INTERPOL's Constitution and its Rules on the Processing of Data. If it no longer does, it is cancelled and member countries are asked to remove the information from national databases.

What are the grounds for removal?

A notice may be published only for a serious ordinary-law crime. Article 83 of the Rules excludes, among others, offences about behavioural or cultural norms, family or private matters, and administrative or private-dispute offences such as unfunded cheques without fraudulent intent.

Notices that breach Article 3 of the Constitution, which forbids activities of a political, military, religious or racial character, are also not published.

How is a request for removal made?

Through the CCF, the independent body that handles applications from individuals, with a reasoned file showing why the notice does not meet INTERPOL's rules.

We prepare the file, the evidence and the supporting documents, and tell you honestly how strong each ground is.

What should I do first?

  1. Gather the foreign warrant or judgment

The removal argument starts from what the requesting country actually relied on.

  2. Map the facts to Article 83 and Article 3

Is it a serious ordinary-law crime, or a private dispute, an administrative matter or a political case?

  3. Build the evidence file

Documents, correspondence and expert material that show why the notice should not stand.

  4. Plan the sequence

We decide whether to approach the CCF first or deal with the national case alongside it.

Frequently asked questions

Does removal clear the underlying case?

Not necessarily. A notice is separate from the national case, so we advise on both.

How long does it take?

It varies with the case and the CCF's workload, so we do not give a fixed time. Confirm the current process on INTERPOL's website.
