Who can issue an arrest warrant?
A judicial police officer may issue one where the accused is not present at the crime scene (Article 47 of the Federal Decree-Law No. 38 of 2022 (Criminal Procedures Law)). The Prosecutor may issue a notice to appear, an arrest warrant or a travel ban according to the circumstances (Article 99).
An arrest warrant is enforced by a public authority officer.
When does the Prosecutor issue a warrant?
Where the accused fails to appear after being served a notice to appear without an acceptable excuse, is likely to escape, has no known place of residence, or was caught in the act, even if the accused cannot be held in custody for the incident (Article 100).
Each warrant must state the accused's details, the charge, the date, the place and time of appearance, and the Prosecutor's name, signature and seal.
How long does a warrant last?
Warrants issued by the Prosecutor are enforceable across all parts of the State and are not enforced after six months from issue unless extended by the Prosecutor for another period (Article 101).
A release order does not prevent a new warrant if the evidence becomes stronger, the accused fails duties imposed, or circumstances require it (Article 112).
How do I find out whether there is a warrant against me?
